Terms of Use

1. Using the platform

By accessing or using the platform, you agree to these Terms of Use. You must be at least 18 years old to use the platform. If you use the platform on behalf of a business or organisation, you confirm that you have the authority to act on its behalf. The platform provides business discovery, listings, requirement posting, matching, enquiries and optional paid memberships.

2. Accounts

You must provide accurate registration details and keep your credentials secure. You are responsible for activity under your account. Accounts may be suspended for misuse.

3. Business listings and accuracy

Businesses are responsible for the accuracy, legality and currency of everything on their listing, including services, pricing, contact details and documents. Listings are reviewed before publication, but review is not an endorsement or a guarantee of accuracy.

4. Requirements, enquiries and leads

Customers may submit requirements or enquiries, which may be matched with relevant businesses. Businesses may receive and respond to those enquiries or leads through the platform. Any communication, quotation, pricing, contract, work, delivery or payment agreed between a customer and a business is strictly between those parties. VYAPARKhoj is not a party to such transactions and does not guarantee leads, responses, service quality, completion, sales or business outcomes.

5. Membership plans

Paid memberships provide the features included in the selected plan for the stated membership period. Features are available only while the membership remains active. On expiry, access to paid features may end and the business listing may revert to the features available under the Free plan. Account, business and transaction information may be retained in accordance with our Privacy Policy and applicable requirements.

Membership does not guarantee leads, customers, enquiries, sales or business success.

6. Payments, GST and invoices

Paid membership prices are subject to applicable taxes, including GST where applicable. Any applicable GST will be calculated and displayed at checkout and reflected on the corresponding invoice. Payments are processed through an authorised third-party payment gateway. A paid membership is activated only after successful payment verification. An invoice is generated for successfully verified paid transactions and made available through the platform. Failed, cancelled or unverified payments do not activate a paid membership. Refunds, reversals and cancellation-related payment matters are governed by our Refund & Cancellation Policy.

7. Verification

Verification badges indicate that submitted business information or documents were reviewed by the platform. Verification does not constitute a guarantee, warranty, certification or government endorsement. Verification status is controlled solely by platform administrators and may be changed or withdrawn. Purchasing a paid plan does not automatically make a business verified.

8. Prohibited conduct

• Submitting false, misleading, forged or third-party documents.
• Impersonating another business or person.
• Scraping, bulk data extraction, spam or automated abuse.
• Posting unlawful, infringing, offensive or harmful content.
• Attempting to bypass access controls, plan limits or verification rules.

9. User content and intellectual property

You retain ownership of the content you submit or upload to the platform. By submitting content, you grant VYAPARKhoj a non-exclusive licence to host, store, process, reproduce and display that content as reasonably necessary to operate, provide and promote your business listing and the platform's services. You are responsible for ensuring that you have the necessary rights to submit such content. VYAPARKhoj's software, design, branding and other platform-owned materials remain the property of VYAPARKhoj or their respective rights holders.

10. Third-party services and availability

The platform may rely on third-party service providers for hosting, database and storage, authentication, OTP delivery, email communications, payment processing and other functionality required to operate the service. While we aim to maintain reliable availability, we do not guarantee that the platform or any third-party service will always be uninterrupted, error-free or available at all times.

11. Disclaimers and limitation of liability

The platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, VYAPARKhoj does not guarantee the accuracy, availability, reliability, quality or outcome of services offered by listed businesses or communications between users. VYAPARKhoj is not responsible for indirect, incidental, special or consequential losses arising from use of the platform or dealings between customers and businesses. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law.

12. Suspension and termination

We may suspend, restrict or terminate accounts, listings or content that violate these Terms, applicable law, platform policies, security requirements or the rights of other users. Where appropriate, we may also restrict access to certain platform features. You may stop using the platform at any time. Suspension or termination does not affect obligations or liabilities that arose before the date of suspension or termination.

13. Changes to these terms

We may update these Terms from time to time to reflect changes in our services, business practices, legal requirements or platform features. The latest version will be published on this page. Where permitted by applicable law, your continued use of VYAPARKhoj after updated Terms become effective will constitute acceptance of the revised Terms. Where appropriate, we may provide additional notice of material changes through the platform or other available communication channels.

14. Platform operator

VYAPARKhoj is operated by National Agro Care Services (NACS). References to “VYAPARKhoj”, “we”, “us” or “our” in these Terms refer to the platform operator, unless the context requires otherwise.

15. Governing law and jurisdiction

These Terms of Use are governed by the laws of India. Subject to applicable law, any dispute arising out of or relating to the use of VYAPARKhoj or these Terms will be subject to the jurisdiction of the competent courts in Bihar, India.
